1. Acceptance of Terms

These Terms of Service (“Terms”) form a binding agreement between you and ScanForge (“ScanForge,” “we,” “us”) governing your access to and use of the ScanForge website, applications, and APIs (collectively, the “Service”). By accessing or using the Service, or by clicking “I agree” during sign-up, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

ScanForge provides QR code generation, management, redirect routing, scan analytics, and related features. Available features vary by subscription plan. We may add, modify, or discontinue features from time to time; material reductions will be communicated in advance where reasonably practicable.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 13 years old to use the Service. If you are located in the European Economic Area or United Kingdom, you must be at least 16 years old (or the minimum age required in your jurisdiction to consent to the processing of personal data).

4. Acceptable Use

You agree not to use the Service to distribute malware, engage in phishing, violate any laws, or generate QR codes that redirect to harmful content. We may suspend or terminate accounts that violate these Terms.

Prohibited uses include, but are not limited to: bot-generated scan traffic, fake traffic inflation, spam QR campaigns, phishing or malware redirects, reselling account access to third parties, API scraping at infrastructure scale, and extreme storage or bandwidth abuse.

5. Fair Use Policy

Plans described as “unlimited” are provided under a fair use model intended for legitimate commercial use. ScanForge does not impose hard caps on QR codes or scans for normal business usage. However, ScanForge reserves the right to throttle, suspend, or require an upgraded Enterprise plan for any account whose usage:

  • materially exceeds normal commercial patterns for the applicable plan tier;
  • negatively impacts platform stability, performance, or other users;
  • involves automated, fraudulent, abusive, or non-human-generated traffic;
  • constitutes resale or sublicensing of the Service to third parties; or
  • is otherwise inconsistent with the intended use of the plan.

Business plan accounts have higher fair-use thresholds than Pro. Enterprise accounts have custom limits agreed upon in writing. ScanForge will make reasonable efforts to notify accounts before taking action, except where immediate suspension is necessary to protect platform integrity.

6. Payments, Billing & Auto-Renewal

Payment processor. Paid plans are processed by Stripe, Inc. Your card or payment details are collected and stored by Stripe, not by ScanForge, subject to Stripe’s own terms and privacy policy.

Auto-renewal. Paid subscriptions are billed on a recurring monthly or annual basis at the plan price in effect at the start of each billing period. Your subscription will automatically renew at the end of each billing period at the then-current rate until you cancel. We will charge your payment method on file at the start of each new period. If the plan price changes for renewing subscribers, we will notify you by email at least seven (7) days before the renewal charge, giving you an opportunity to cancel before the new rate takes effect.

How to cancel. You may cancel at any time from your account billing page or by emailing billing@scanforge.co. Cancellation takes effect at the end of the then-current billing period; your plan features remain available until that date.

7-day money-back guarantee. If you cancel within seven (7) days of your first paid charge on a plan, you may request a full refund of that charge by emailing billing@scanforge.co. The 7-day window applies to each account’s first paid subscription only; renewal charges and subsequent plan changes are not refundable, though unused paid time carries through to the end of the billing period in which you cancel.

Taxes. Listed prices are exclusive of taxes unless otherwise stated. You are responsible for any applicable sales, use, or VAT taxes, which Stripe may collect where required.

7. Intellectual Property

ScanForge retains all rights, title, and interest in and to the Service, including the software, designs, and marks. You retain ownership of the content and data you create using the Service. You grant ScanForge a worldwide, non-exclusive, royalty-free license to host, process, and display your content solely to operate and improve the Service as described in our Privacy Policy.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SCANFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. SCANFORGE’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO SCANFORGE FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Changes to Terms

We may update these Terms from time to time. For material changes, we will provide reasonable advance notice by email or by posting a notice within the Service. Continued use of the Service after the effective date of an update constitutes acceptance of the revised Terms.

11. Governing Law & Venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Monroe County, New York for any dispute arising out of or relating to these Terms or the Service, subject to Section 12 below.

12. Dispute Resolution

Informal resolution first. Before filing any formal claim, you agree to contact us at legal@scanforge.co with a written description of the dispute and the relief you seek. The parties will attempt to resolve the dispute in good faith for at least thirty (30) days before either side pursues formal legal action.

Small-claims preserved. Nothing in these Terms prevents either party from bringing an individual action in small-claims court for claims within that court’s jurisdiction.

No class actions. Claims must be brought on an individual basis; you may not bring or join a class action, consolidated action, or representative proceeding against ScanForge.

13. Termination

You may terminate your account at any time. We may suspend or terminate your account if you materially breach these Terms, if required by law, or if continued operation of your account would expose ScanForge or other users to harm. Upon termination, Sections 7 (IP), 8 (Disclaimer), 9 (Limitation of Liability), 11 (Governing Law), 12 (Dispute Resolution), and 14 (Contact) survive.
